Employee Sexual Misconduct Policy

It is the policy of Unionville College (the "College") to ensure that all students are entitled to an academic setting free from sexual comments or physical contact initiated by college employees, including faculty, that could be construed as sexual solicitation or advances.

SCOPE

 

This policy applies to all employees of the college, as defined by the Employment Standards Act, 2000 ("ESA"). It does not cover consensual sexual or romantic relationships unless they qualify as a Prohibited Relationship under this policy.

​

 

DEFINITIONS

​

Sexual Misconduct - refers to any of the following actions by a college employee towards a student:

(a) Engaging in physical sexual relations, sexually touching, or making sexual remarks towards the student where:

 

I. the behavior is criminal under the Criminal Code (Canada),

II. it violates the student's rights under clause 7 (3) (a) of the Human Rights Code regarding freedom from sexual solicitation or advances,

III. it is considered sexual misconduct under this policy or breaches any college rule regarding employee-student sexual relations. (b) Any behavior by an employee that violates the student's rights under clause 7 (3) (b) of the Human Rights Code to be free from retaliation for rejecting sexual advances.

Student – refers to an individual currently enrolled at Unionville College, whether in a full-time, part-time, or continuing education capacity.

POLICY ELABORATION

 

Reporting - Complaints should be reported following the procedures outlined in the College’s Discrimination and Harassment Prevention Policy, Complaints Against Employees, Formal Complaint. Complainants are also encouraged to consult the Unionville College Sexual Assault & Sexual Violence Policy and Procedure for additional guidance and support.

​

 

Disciplinary Measures – If found guilty of Sexual Misconduct, an employee may face disciplinary actions, up to and including dismissal from employment. Such disciplinary actions will be regarded as just cause for termination without notice, termination pay, or any other form of compensation.

 

 

Reemployment – Any employee who is dismissed or resigns due to an act of Sexual Misconduct against a student will not be rehired by the College.

​

 

Disclosure – the College will not enter into an agreement which prohibits disclosure that an allegation or complaint has been made that an employee of the College commited an act of Sexual Misconduct toward a student unless such request is made by the student and,

(a) the student has had a reasonable opportunity to receive independent legal advice

(b) there have been no undue attempts to influence the student with respect to the request

(c) the agreement includes an opportunity for the student to decide to waive their own confidentiality in the future and the process for doing so, and

(d) the agreement is of a set and limited duration.
